Part one

Privacy Policy

1. Overview

Magen Estate Stewardship LLC (“Magen,” “we,” “us,” or “our”) respects the privacy of prospective clients, clients, authorized portal users, and website visitors. This Privacy Policy applies to information handled through magenestate.com, our inquiry form, the private client portal, and related digital communications. It does not replace any privacy terms in a signed client agreement; if those terms differ, the signed agreement controls for the services it covers.

2. Information we collect

Depending on how you interact with Magen, we may collect:

  • Inquiry information: your name, email address, phone number, property location, inquiry type, message, and any other details you choose to provide.
  • Account and client information: your name, contact information, account role, account status, login and verification records, and relationships between authorized users, clients, and properties.
  • Property and service information: property addresses, access instructions, service schedules, checklists, visit notes, visible-condition observations, photographs, documents, invoices, recommendations, and vendor-coordination details.
  • Visit verification information: service timestamps and, when an authorized professional uses the reporting tools, device-provided location coordinates and accuracy information associated with visit activity.
  • Technical and security information: browser and device information, request metadata, authentication events, security audit events, and limited network information used for access control, fraud prevention, and rate limiting.

The website does not currently collect payment-card information or process online payments. Please do not send passwords, payment-card details, alarm codes, keys, or other highly sensitive access information through the public inquiry form.

3. How we use information

We use information to:

  • respond to inquiries and arrange consultations;
  • establish, administer, and secure client accounts;
  • schedule, perform, document, and communicate about agreed property services;
  • prepare and deliver visit reports, photographs, documents, and invoices through the private portal;
  • coordinate approved vendors, property access, follow-up work, and emergency communications;
  • send account invitations, password-recovery messages, and one-time access codes;
  • operate, maintain, troubleshoot, and protect the website and portal; and
  • comply with law and enforce our agreements.

We do not sell personal information. We do not use portal or inquiry information for third-party behavioral advertising.

4. Sharing and service providers

We share information only as reasonably necessary for the purposes described above. Recipients may include:

  • Technology providers: Supabase for portal authentication, database, and private file storage; Resend for inquiry and account-related email delivery; and our website hosting and security providers.
  • Advertising measurement: if you allow optional measurement, Google receives advertising identifiers, browser and device information, and successful enquiry events to help us measure our Google Ads campaigns. We do not include the enquiry’s name, email address, phone number, property location, or message in these events. For ad-related calls, a Google forwarding number may appear on our public website and route to our business number. Google can process call details such as the caller’s number, call time, duration, and whether the call connected to measure which ads generate phone enquiries.
  • Authorized vendors and professionals: service providers you approve or whose involvement is reasonably necessary to carry out agreed services, subject to the scope of our agreement and your instructions.
  • Legal and safety recipients: government authorities, emergency responders, insurers, advisers, or other parties when reasonably necessary to comply with law, protect a person or property, investigate misuse, or establish or defend legal rights.
  • Business-transition recipients: parties to a merger, financing, reorganization, sale, or similar transaction, subject to appropriate confidentiality protections.

Our providers process information under their own service terms and privacy commitments. The website may also contain links to third-party sites; their practices are governed by their own policies, not this one.

5. Cookies and device storage

Optional Google Ads measurement is off unless you allow it through our privacy choices. If allowed, Google’s tag may use cookies and receive information such as your IP address, browser and device details, advertising click identifiers, the public page visited, and a successful enquiry event. This helps us understand which ads generate enquiries, including calls through a Google forwarding number. We do not enable personalized advertising or enhanced conversions through this measurement setup, and we do not load it in the private portal or administrator area.

You can allow or decline optional measurement, or withdraw your choice later, using “Privacy choices” in the public website footer. We remember your choice in this browser for up to 180 days. A supported Global Privacy Control signal keeps optional measurement off. Declining does not prevent you from browsing or sending an enquiry. Withdrawing stops subsequent enquiry conversion events from this website; it does not erase data already sent to Google or automatically remove existing cookies. You can clear cookies through your browser settings. Google’s own data practices are explained in its Privacy Policy and advertising information.

The private portal uses browser storage and similar essential technologies to maintain authentication, remember access state, protect accounts, and support limited offline functionality for authorized users. For example, an authorized professional’s device may temporarily retain an in-progress visit report, checklist responses, timestamps, location verification, and photos until they can be synchronized. The administrative portal may also cache required application files for reliable offline use.

You can clear browser data through your browser or device settings. Doing so may sign you out, remove unsynchronized work, or prevent parts of the portal from functioning as intended.

6. Security and retention

We use administrative, technical, and organizational safeguards designed to protect information. Current controls include authenticated portal access, email verification codes, database access policies, private storage for client documents and photos, short-lived download links, and security logging. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We retain information for as long as reasonably necessary to provide services, maintain business and tax records, resolve disputes, enforce agreements, protect security, and comply with law. Retention periods vary by record type and client relationship. Device-cached information may remain until it is synchronized, cleared, or the authorized user signs out.

7. Your choices and privacy requests

You may ask us to correct contact or account information, request access to information we maintain about you, or ask that we delete information, subject to legal, contractual, security, and recordkeeping requirements. Portal users can update certain account details or contact us for assistance. You may opt out of nonessential communications by following the instructions in the message or contacting us. Account-security and service messages may still be sent when necessary.

Our services are not directed to children under 18, and we do not knowingly collect personal information from them through this website. If you believe a child has provided information, please contact us so we can review and remove it as appropriate.

Part two

Terms of Service

1. Acceptance and scope

These Terms of Service (“Terms”) govern your access to and use of magenestate.com and the Magen private client portal. By using the website or portal, you agree to these Terms. If you use the portal or act for another person or entity, you represent that you are authorized to do so. If you do not agree, do not use the website or portal.

2. Services and client agreements

Website descriptions are general information, not a proposal or promise to provide a particular service. The exact scope, schedule, access permissions, fees, payment terms, cancellation terms, emergency authority, and other service conditions are set out in a separate written proposal, service agreement, or other written authorization. If these Terms conflict with a signed client agreement, the signed client agreement controls for the services it covers.

Portal records, visit reports, invoices, and status indicators are provided for convenience and documentation. An obvious clerical, technical, or synchronization error does not modify the parties’ written agreement or create an obligation beyond it.

3. Home Watch and observation limitations

Professional Home Watch and related property visits consist of visual, non-invasive observations of agreed and reasonably accessible areas at the scheduled time. They are not a home inspection, engineering analysis, building-code inspection, environmental assessment, security guarantee, pest inspection, mold assessment, or warranty. Conditions can arise or change between visits, and concealed, intermittent, inaccessible, or technically specialized conditions may not be observed.

Moisture, humidity, temperature, infrared, or similar readings are screening observations for reporting purposes. They are not laboratory results or professional diagnoses. Clients should engage appropriately licensed specialists to investigate, diagnose, repair, or certify conditions when needed.

4. Property access, instructions, emergencies, and vendors

Clients are responsible for providing timely, accurate access instructions, authorized contacts, vendor information, and known hazards, and for keeping those details current. We may postpone or stop work when access is unavailable or conditions appear unsafe. Any emergency response, purchase, repair, or vendor authorization is limited to the authority granted in the applicable written agreement or by the client.

Unless a written agreement says otherwise, third-party vendors and licensed professionals are independent businesses, not employees or agents of Magen. Coordination, access, observation, or communication concerning a vendor does not guarantee the vendor’s availability, pricing, workmanship, licensing, insurance, or results.

5. Private portal and account use

Portal access is invitation-only and intended for authorized users. You must provide accurate information, protect your login credentials and email account, use verification codes only for your own session, and promptly notify us of suspected unauthorized access. You may not share access with an unauthorized person, attempt to bypass security, probe the service, upload malicious or unlawful material, or access another client’s information.

You retain ownership of materials you provide. You grant Magen permission to host, copy, process, and share those materials as reasonably necessary to operate the portal, provide authorized services, comply with law, and protect the parties. You represent that you have the right to provide the materials and instructions you submit. We may suspend access to protect security, investigate misuse, comply with law, or administer a client relationship.

6. Website use, intellectual property, and links

The website, its design, branding, text, graphics, reports, templates, and software are owned by or licensed to Magen and are protected by applicable intellectual-property laws. You may use them for personal, lawful evaluation or receipt of our services. You may not copy, sell, scrape, reverse engineer, interfere with, or exploit the website or portal except as permitted by law or in writing by Magen.

Third-party links and services are provided for convenience. We do not control and are not responsible for their content, availability, security, or practices. Use them at your own discretion and review their terms and policies.

7. Availability, disclaimers, and limitation of liability

We work to keep the website and portal accurate, secure, and available, but they may contain errors or experience maintenance, outages, delays, or data-synchronization issues. To the fullest extent permitted by law, the website and portal are provided “as is” and “as available,” without warranties of uninterrupted availability, complete accuracy, or fitness for a particular purpose.

To the fullest extent permitted by law, Magen will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of, or inability to use, the website or portal. Service-related responsibility and any applicable limitations are governed by the signed client agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

8. Governing law and general terms

These Terms are governed by Florida law, without regard to its conflict-of-law principles. Subject to any dispute-resolution provision in a signed client agreement, disputes concerning the website or portal will be brought in the state or federal courts located in or serving Palm Beach County, Florida, and the parties consent to their jurisdiction.

If a provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our written consent. These Terms and the Privacy Policy may be updated as our services, technology, or legal obligations change. We will post the revised version here and update the effective date. Continued use after an update means you accept the revised Terms.
